PACKETSNITCH END USER LICENSE AGREEMENT

This End User License Agreement (“Agreement” or “EULA”) is a legally binding agreement between you (“User,” “you,” or “your”) and Marshall Whittaker dba oxasploits (“oxasploits,” “PacketSnitch,” “we,” “us,” or “our”) governing your download, installation, access to, purchase of, subscription to, and use of the PacketSnitch software application, associated components, add-ons, services, websites, documentation, and related materials (collectively, the “Software” or “PacketSnitch”).

PacketSnitch is a network capture and packet analysis application intended to assist users in examining, interpreting, organizing, and analyzing network capture data, including PCAP and PCAPNG data.

By downloading, installing, purchasing, accessing, or using PacketSnitch, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, do not install, access, purchase, or use PacketSnitch.

References in this Agreement to “PacketSnitch,” “oxasploits,” “we,” “our,” or “us” refer to Marshall Whittaker dba oxasploits, as applicable.

2. LICENSE GRANT

Subject to your compliance with this Agreement and, where applicable, payment of all required license or subscription fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use PacketSnitch for lawful purposes.

This Agreement grants you a license to use the Software. Except for components expressly distributed under an open-source license, no ownership interest in PacketSnitch or its proprietary components is transferred to you.

Certain components of PacketSnitch may be made available under separate open-source licenses. Where an applicable open-source license conflicts with this Agreement regarding an open-source component, the terms of that open-source license control with respect to that component.

Commercial features, add-ons, themes, subscriptions, services, or other separately licensed components may be subject to additional terms or license restrictions.

3. AUTHORIZED AND LAWFUL USE

PacketSnitch is a network capture analysis tool and may be capable of analyzing sensitive network communications, credentials, authentication material, files, metadata, protocol contents, personally identifiable information, or other data contained within network captures.

You are solely responsible for ensuring that you have all permissions, authorizations, and legal rights necessary to capture, possess, access, analyze, store, process, disclose, or otherwise use any data analyzed with PacketSnitch.

You agree not to use PacketSnitch in violation of any applicable local, state, federal, national, or international law or regulation.

PacketSnitch does not grant you permission or authority to intercept, monitor, access, analyze, or obtain information belonging to another person, organization, network, computer system, or device.

4. RESPONSIBILITY FOR ANALYSIS AND INFORMATION OBTAINED

You are solely responsible for your use of PacketSnitch and for any information, conclusions, evidence, credentials, files, communications, network data, indicators, or other material you obtain, discover, extract, reconstruct, infer, or generate through use of the Software.

Marshall Whittaker dba oxasploits is not responsible for what you do with information obtained through PacketSnitch.

You assume all responsibility for determining whether your collection, analysis, retention, disclosure, publication, transmission, or other use of such information is lawful and appropriate.

PacketSnitch is an analysis tool and should not be treated as a guarantee that any analysis, protocol decoding, classification, reconstruction, automated conclusion, generated summary, or other output is accurate or complete.

You are responsible for independently validating PacketSnitch output before relying upon it for security, forensic, evidentiary, operational, legal, disciplinary, financial, or other consequential decisions.

5. USER DATA AND INFORMATION WE COLLECT

In connection with PacketSnitch, our websites, licensing systems, subscriptions, support services, purchases, and related services, we may collect and process information including, but not limited to:

  • Your name;
  • Email address;
  • Telephone number;
  • Billing address;
  • Subscription and license information;
  • Transaction and purchase information;
  • An installation identifier or installUUID;
  • Application version and platform information;
  • Device, operating system, and installation information;
  • Usage and feature interaction metrics;
  • Diagnostic, error, crash, and performance information;
  • Communications you send to us;
  • Support requests and related technical information; and
  • Other information reasonably necessary to operate, license, maintain, secure, support, and improve PacketSnitch and associated services.

Additional details concerning our handling of personal information may be provided in an applicable Privacy Policy.

6. USAGE METRICS AND TELEMETRY

PacketSnitch may collect usage metrics, telemetry, diagnostic information, feature usage information, installation information, and related application data.

Where provided by PacketSnitch, you may opt out of optional usage metrics collection through the applicable application setting or other mechanism we provide.

Certain information may nevertheless be necessary to provide requested services, authenticate licenses or subscriptions, process transactions, prevent fraud or abuse, provide updates, diagnose errors, or maintain the security and operation of PacketSnitch and its associated services.

7. PAYMENT PROCESSING AND PADDLE

We use Paddle and/or its affiliated services as a subscription, checkout, billing, and payment backend for paid PacketSnitch products and services.

When you purchase a license, subscription, add-on, or other paid product, Paddle may collect and process financial, billing, transaction, identity, tax, fraud-prevention, and payment information in accordance with Paddle’s own terms and privacy policies.

Payment card and other financial information submitted directly through Paddle is collected and processed by Paddle and its payment partners. We may receive transaction-related information from Paddle, including information necessary to identify your purchase, maintain your subscription, administer your license, provide support, and fulfill our legal or accounting obligations.

Your use of Paddle’s payment services may be subject to separate agreements between you and Paddle.

8. SUBSCRIPTIONS AND LICENSES

Certain PacketSnitch functionality may require a paid license, subscription, add-on, or other entitlement.

Subscription prices, billing intervals, included functionality, license restrictions, and renewal terms are those disclosed to you at the time of purchase or within the applicable product offering.

Unless otherwise stated at the time of purchase, subscriptions may automatically renew according to the billing interval selected during checkout until canceled in accordance with the applicable subscription procedures.

Cancellation of a subscription prevents future renewals as provided by the applicable billing terms but does not entitle you to a refund for amounts already paid except where a refund is required by applicable law.

We may modify, discontinue, replace, restrict, or otherwise alter paid features, subscription plans, licensing models, or services to the extent permitted by applicable law.

9. REFUND POLICY

ALL SALES ARE FINAL. WE MAINTAIN A ZERO-REFUND POLICY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Payments for PacketSnitch licenses, subscriptions, add-ons, digital products, or other services are non-refundable and non-creditable once charged, except where a refund is expressly required by applicable law.

Canceling a subscription does not retroactively refund previous payments.

Nothing in this section eliminates any mandatory refund, cancellation, or consumer rights that cannot legally be waived.

10. TERMINATION AND SUSPENSION

To the maximum extent permitted by applicable law and any applicable contractual obligations, we reserve the right to suspend, restrict, discontinue, or terminate your access to PacketSnitch-related services, subscriptions, hosted services, accounts, license services, support, downloads, updates, or other services at any time and for any reason, including suspected misuse, fraud, violation of this Agreement, security concerns, abuse of our infrastructure, or legal or regulatory requirements.

Where permitted by law, such suspension or termination may occur with or without prior notice.

Termination or suspension does not relieve you of obligations incurred before termination and does not automatically entitle you to a refund.

Provisions of this Agreement that by their nature should survive termination, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, and governing law, will survive termination.

11. SOFTWARE AVAILABILITY

We do not guarantee that PacketSnitch, its websites, subscription infrastructure, licensing systems, downloads, updates, online services, documentation, integrations, or other services will always be available.

Services may be interrupted, modified, suspended, or discontinued for maintenance, technical failures, security reasons, business reasons, legal requirements, third-party failures, or other causes.

We may add, remove, modify, replace, or discontinue features of PacketSnitch at our discretion, subject to applicable law.

12. THIRD-PARTY SOFTWARE AND SERVICES

PacketSnitch may incorporate, communicate with, rely upon, or provide interoperability with third-party software, libraries, protocols, APIs, services, websites, models, databases, or other technologies.

We do not control third-party products and do not guarantee their availability, security, accuracy, compatibility, or continued operation.

Third-party software or services may be subject to separate licenses, terms of service, or privacy policies.

13. INTELLECTUAL PROPERTY

PacketSnitch, including its proprietary source code, object code, interfaces, graphics, branding, documentation, commercial components, website content, and related intellectual property, is owned by Marshall Whittaker dba oxasploits or its applicable licensors except where expressly identified otherwise.

Nothing in this Agreement transfers ownership of our trademarks, service marks, trade names, copyrights, proprietary software, or other intellectual property.

The names PacketSnitch and oxasploits, associated logos, and related branding may not be used in a manner that falsely suggests sponsorship, endorsement, affiliation, or authorization.

Open-source components remain governed by their respective licenses.

14. RESTRICTIONS

Except where expressly permitted by an applicable open-source license or applicable law, you may not:

  • Circumvent licensing, subscription, authentication, or access-control mechanisms;
  • Remove or alter proprietary notices;
  • Redistribute proprietary paid components without authorization;
  • Sell, sublicense, rent, lease, or commercially redistribute proprietary PacketSnitch components except as expressly authorized;
  • Use PacketSnitch services to interfere with, damage, disrupt, or gain unauthorized access to our infrastructure or the infrastructure of others; or
  • Use the Software in a manner that violates applicable law or the rights of another person or entity.

Nothing in this section restricts rights granted to you by an applicable open-source license.

15. NO WARRANTY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKETSNITCH AND ALL RELATED SOFTWARE, SERVICES, CONTENT, DOCUMENTATION, OUTPUTS, AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE DISCLAIM, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AVAILABILITY, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT PACKETSNITCH WILL IDENTIFY EVERY PACKET, PROTOCOL, THREAT, ARTIFACT, CREDENTIAL, SECURITY ISSUE, MALWARE INDICATOR, OR OTHER CONDITION, OR THAT ANY DECODING, ANALYSIS, STATISTIC, CLASSIFICATION, SUMMARY, OR OTHER OUTPUT WILL BE COMPLETE OR ACCURATE.

NETWORK ANALYSIS AND SECURITY SOFTWARE CAN PRODUCE INCOMPLETE, AMBIGUOUS, OR INCORRECT RESULTS. YOU ARE RESPONSIBLE FOR VERIFYING RESULTS BEFORE ACTING UPON THEM.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARSHALL WHITTAKER DBA OXASPLOITS AND ITS AFFILIATES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, CREDENTIALS, PRIVACY, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO PACKETSNITCH.

THIS INCLUDES DAMAGES ARISING FROM OR RELATED TO:

  • USE OR INABILITY TO USE PACKETSNITCH;
  • INCORRECT OR INCOMPLETE ANALYSIS;
  • LOSS OR CORRUPTION OF CAPTURE DATA;
  • SECURITY INCIDENTS;
  • DISCLOSURE OR MISUSE OF INFORMATION;
  • RELIANCE UPON SOFTWARE OUTPUT;
  • THIRD-PARTY SOFTWARE OR SERVICES;
  • INTERRUPTION OR TERMINATION OF SERVICES; OR
  • ACTIONS TAKEN BY YOU OR OTHERS BASED UPON INFORMATION OBTAINED THROUGH PACKETSNITCH.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATING TO PACKETSNITCH OR THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE APPLICABLE PACKETSNITCH PRODUCT OR SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain exclusions or limitations of liability. In such jurisdictions, these limitations apply only to the maximum extent permitted by law.

17. INDEMNIFICATION

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Marshall Whittaker dba oxasploits and its affiliates, contractors, service providers, representatives, and licensors from claims, liabilities, damages, judgments, losses, costs, and reasonable expenses arising from or related to:

  1. Your unlawful or unauthorized use of PacketSnitch;
  2. Your violation of this Agreement;
  3. Your violation of another person’s rights;
  4. Your capture, interception, possession, analysis, disclosure, publication, or use of network data;
  5. Information or material you obtain through PacketSnitch; or
  6. Your violation of applicable law.

18. SECURITY AND SENSITIVE DATA

Network captures can contain highly sensitive information. Depending upon the traffic being analyzed, this may include passwords, authentication tokens, cookies, private communications, personally identifiable information, confidential business information, cryptographic material, network topology, device identifiers, or other sensitive data.

You are responsible for securing capture files, exported data, reports, analysis results, credentials, keys, and other information in your possession.

You should treat capture files and analysis results according to the sensitivity of the information they contain.

19. CHANGES TO THIS AGREEMENT

We reserve the right to modify, revise, replace, or otherwise change this EULA at any time.

When we make changes, we may update the “Last Updated” date and may provide additional notice through PacketSnitch, our website, email, or another reasonable method where appropriate or legally required.

Changes will become effective as specified in the updated Agreement, subject to applicable law.

Your continued use of PacketSnitch after an updated Agreement becomes effective constitutes acceptance of the revised Agreement to the extent permitted by applicable law. If you do not agree to a revised Agreement, you must discontinue use of PacketSnitch and associated services.

Changes to this Agreement will not retroactively eliminate rights that cannot legally be modified or waived.

20. PRIVACY

Your use of PacketSnitch may also be subject to our Privacy Policy and other privacy disclosures made available through PacketSnitch or https://packetsnitch.com.

Where the terms of a separate Privacy Policy concern the collection, processing, retention, disclosure, or protection of personal information, that Privacy Policy supplements this Agreement.

21. EXPORT AND SANCTIONS COMPLIANCE

You agree to comply with applicable export-control, sanctions, and trade laws in connection with your use, transfer, or distribution of PacketSnitch.

You may not use, export, re-export, transfer, or otherwise provide PacketSnitch where doing so would violate applicable law.

22. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

To the extent a dispute may lawfully be required to be brought in a particular jurisdiction under this Agreement, you consent to the jurisdiction of the applicable state and federal courts located in North Carolina, subject to any non-waivable rights provided by applicable law.

23. SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or, where appropriate, severed from this Agreement. The remaining provisions shall remain in full force and effect.

24. WAIVER

Our failure to enforce any provision of this Agreement does not constitute a waiver of that provision or of our right to enforce it later.

A waiver of one breach does not constitute a waiver of any subsequent breach.

25. ASSIGNMENT

You may not assign or transfer your rights or obligations under this Agreement without our prior written consent, except where applicable law provides otherwise.

We may assign or transfer this Agreement in connection with a sale, transfer, restructuring, merger, acquisition, reorganization, or other transfer of all or part of the PacketSnitch business or assets, subject to applicable law.

26. ENTIRE AGREEMENT

This Agreement, together with any applicable Privacy Policy, purchase terms, subscription terms, open-source licenses, and other terms expressly incorporated by reference, constitutes the applicable agreement between you and us concerning your use of PacketSnitch.

Where separately applicable terms conflict, the more specific terms govern the subject matter to which they apply unless otherwise stated.

27. ELECTRONIC ACCEPTANCE

You agree that electronic acceptance of this Agreement has the same legal effect as a handwritten signature to the extent permitted by applicable law.

Acceptance may be demonstrated by clicking an acceptance button or checkbox, completing a purchase where this Agreement is presented as part of the transaction, installing or activating PacketSnitch after being presented with this Agreement, or another electronic acceptance mechanism.

BY DOWNLOADING, INSTALLING, PURCHASING, ACTIVATING, ACCESSING, OR USING PACKETSNITCH, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS END USER LICENSE AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS.
